Terms of Service

Article 1 (Purpose)

These terms and conditions aim to establish the terms of use, procedures, and other necessary matters for the otu.ai service (hereinafter "Service") operated by the non-profit organization OpenTutorials (hereinafter "Operator").

Article 2 (Definitions)

  1. "Service" refers to the memo app service provided by the Operator.
  2. "Member" refers to a user who accesses the service and uses the services provided by the Operator in accordance with these terms.
  3. "Usage Fee" refers to the subscription fee that allows for increased usage of features requiring significant costs, such as AI, when exceeding the free usage limit, while basic memo features are provided free of charge.

Article 3 (Effect and Changes of Terms of Service)

  1. These terms take effect upon posting and announcement on the service screen.
  2. The Operator may modify these terms within the scope not violating relevant laws when reasonable causes arise.

Article 4 (Use of Service)

  1. The service has no age restriction and is available to anyone.
  2. Members can use basic memo features for free, and features requiring significant costs, such as AI, can be used through subscription when exceeding the free usage limit.

Article 5 (Service Termination)

  1. The Operator will provide notice at least 3 months prior to service termination, and users can download their data.

Article 6 (Member Obligations)

  1. Members must comply with these terms and relevant laws.
  2. Members may not engage in any profit-making activities using the service without prior consent from the Operator.

Article 7 (Personal Information Protection)

The Operator makes its best efforts to protect members' personal information and processes personal information in accordance with relevant laws and the privacy policy.

Article 8 (Miscellaneous)

  1. Matters not specified in these terms shall be governed by relevant laws and customary practices.

These Terms of Service are effective from June 20, 2024.

Article 9 (License Grant)

The Operator grants the Member a limited, non-exclusive, non-transferable license to use the Service and associated software (hereinafter "App") solely for personal use. The Member may not reproduce, distribute, modify, or reverse engineer the App without prior written consent from the Operator.

Article 10 (Disclaimer and No Warranty)

The Service is provided on an "as is" basis without any warranties, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Member acknowledges that the use of the Service is at their own risk, and the Operator shall not be liable for any errors, interruptions, or damages arising from its use.

Article 11 (Limitation of Liability)

To the fullest extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, consequential, or special damages (including, without limitation, loss of data, loss of business, or other economic losses) arising from the use or inability to use the Service. The total liability of the Operator shall not exceed the amount actually paid by the Member for the Service.

Article 12 (Export Restrictions)

Members shall use the Service and associated software in compliance with all applicable export control laws and regulations. The Member is solely responsible for ensuring that the use of the Service does not violate any export control laws.

Article 13 (Governing Law and Dispute Resolution)

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Seoul Central District Court.

Privacy Policy

This Privacy Policy explains the measures taken by the non-profit organization OpenTutorials (hereinafter referred to as "Operator") to protect the personal information of users of the otu.ai service (hereinafter referred to as "Service").

Article 2 (Collection and Use of Personal Information)

The Operator collects minimal personal information necessary for service provision, and the collected personal information is used for the following purposes:

  1. Service provision and operation
  2. Member management
  3. Service improvement and new service development

Article 3 (Data Management Methods)

  1. User data access rights: Only a limited number of authorized engineers can access real data in a strictly controlled environment.
  2. Data retention period: Data is immediately deleted after membership withdrawal.

Article 4 (Data Provided to Third Parties)

  1. Text data: supabase database (SOC 2 Type 2)
  2. Image files: uploadcare (SOC 2 Type 2 and ISO 27001)
  3. AI chat, AI content generation: openai (SOC 2 Type 2)
  4. Embeddings: User data is vectorized and stored for AI-based responses using cohere (SOC 2 Type II, ISO 27001)
  5. User authentication information: Using social login through apple, google, and github, the Operator does not store user authentication information.

Article 5 (Methods for User Data Modification and Deletion Requests)

Users can modify or request deletion of their data using the withdrawal function in the service settings menu.

Article 6 (Technical and Administrative Measures for Personal Information Protection)

The Operator implements various security measures to prevent unauthorized access and leakage of personal information.

Article 7 (Notification Obligation for Policy Changes)

In case of additions, deletions, or modifications to this Privacy Policy, changes will be announced within the service at least 7 days prior to implementation.

This Privacy Policy is effective from June 20, 2024.
